SEVAHETU – TERMS & CONDITIONS
1. INTRODUCTION
These Terms and Conditions (“Terms”) govern the use of services made available on or through https://www.sevahetu.com and/or the Sevahetu mobile application (collectively, the “Platform”, and together with the services made available on or through the Platform, the “Services”).
These Terms also include our Privacy Policy, available on the Platform (“Privacy Policy”), and any guidelines, additional, or supplemental terms, policies, and disclaimers made available or issued by us from time to time (“Additional Terms”). The Privacy Policy and Additional Terms form an integral part of these Terms.
These Terms constitute a legally binding agreement between Sevahetu (“Company”, “we”, “us”, or “our”) and you, the user of the Services (“you” or “User”).
By accessing or using the Platform, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform or Services.
2. NATURE OF SERVICES
2.1 Sevahetu is a non-medical facilitation platform that provides:
- Hospital navigation support
- Emergency coordination assistance
- General informational support
2.2 Sevahetu does not provide:
- Medical services
- Ambulance services
- Healthcare advice or treatment
2.3 The Platform acts solely as a technology intermediary and does not control or guarantee the outcome of any assistance provided.
3. USER CONSENT AND DATA SHARING
3.1 By using the Platform, you expressly consent to:
- Collection and processing of your personal data
- Sharing of limited data with responders and coordinators
- Temporary sharing of contact details during pilot phases, where applicable
3.2 Data may also be accessed by internal coordinators for emergency handling and hospital assistance.
4. ROLE OF COORDINATORS
4.1 Sevahetu coordinators assist in:
- Monitoring emergency situations
- Facilitating hospital coordination
- Providing operational support
4.2 Coordinators do not provide medical advice, diagnosis, or treatment.
5. THIRD-PARTY RESPONDERS
5.1 Responders (including drivers or assistance personnel) are independent third-party service providers.
5.2 They are not employees, agents, or representatives of Sevahetu.
5.3 Sevahetu shall not be responsible for:
- Their actions or omissions
- Quality or timeliness of their services
6. SERVICE AVAILABILITY
6.1 Services are dependent on:
- Location
- Availability of responders
- Network and technical conditions
6.2 Sevahetu does not guarantee:
- Immediate response
- Continuous or uninterrupted service
7. USER OBLIGATIONS
You agree to:
- Provide accurate and complete information
- Use the Platform only for genuine emergency situations
- Not misuse, abuse, or attempt to exploit the service
8. PAYMENTS AND PRICING
8.1 Sevahetu may introduce:
- Paid services
- Subscription plans
- Service-based pricing
8.2 All applicable charges, including taxes, will be displayed on the Platform.
8.3 Pricing may be modified at any time at our discretion.
8.4 Payments are subject to applicable refund and cancellation policies.
9. LIMITATION OF LIABILITY
To the fullest extent permitted:
Sevahetu shall not be liable for:
- Delays or failure in service delivery
- Actions or negligence of responders
- Medical outcomes or consequences
- Indirect or consequential damages
10. NO GUARANTEE OF OUTCOME
10.1 Emergency situations involve inherent uncertainty.
10.2 Sevahetu does not guarantee:
- Medical outcomes
- Successful assistance
- Survival or recovery
10.3 INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Sevahetu, its founders, directors, employees, coordinators, and third-party responders from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal and attorney fees) arising out of or in any way connected with:
- Your access to or use of the Platform and Services;
- Your breach or violation of any of these Terms and Conditions;
- Your provision of false, inaccurate, or incomplete information (including but not limited to emergency details or medical information);
- Any misuse, abuse, or fraudulent activity conducted by you on the Platform (such as raising fake SOS requests);
- Your violation of any applicable laws, regulations, or the rights of any third party.
11. EMERGENCY DISCLAIMER
Sevahetu is a facilitation platform and is not a substitute for official emergency services. Users are strongly advised to contact government-authorized emergency helplines, including 112 India Emergency Helpline, in critical situations. Sevahetu does not guarantee immediate response or availability of assistance during emergencies.
11.1 Sevahetu is not a substitute for official emergency services.
11.2 PILOT / BETA PHASE DISCLAIMER
- Experimental Nature: The User acknowledges and agrees that the Platform and Services are currently in a pilot/beta testing phase. The Services are provided strictly on an “AS-IS” and “AS-AVAILABLE” basis without any warranties of any kind, whether express or implied.
- Inherent Risks of Pilot Phase: During this phase, the Platform may contain bugs, glitches, errors, or experience network, technical, or logistical interruptions. Sevahetu does not guarantee continuous, error-free, immediate, or secure operation of the Platform or the coordination services.
- No Liability for Failures: To the maximum extent permitted by law, Sevahetu expressly disclaims any liability for any service failures, delays in responder assignment or hospital coordination, data loss, or inability to access the Platform resulting from the experimental nature of this pilot phase.
- Right to Modify or Terminate: Sevahetu reserves the absolute right to modify, suspend, limit, or discontinue the pilot Services, in whole or in part, at any time without prior notice or liability to the User.
12. DATA SECURITY
12.1 Sevahetu implements reasonable safeguards to protect user data.
12.2 However, we do not guarantee absolute security of:
- Data transmission
- Data storage
12.3 Users acknowledge risks associated with digital communication.
13. LOCATION ACCURACY
13.1 The Platform relies on device-based location services.
13.2 Accuracy may be affected by:
- Network conditions
- Device limitations
- External factors
13.3 Sevahetu does not guarantee location accuracy.
14. THIRD-PARTY INFRASTRUCTURE
14.1 Sevahetu uses third-party infrastructure for data storage and processing.
14.2 By using the Platform, you acknowledge:
- Data may be stored on external secure servers
- Data may be processed across multiple locations
14.3 Sevahetu shall not be liable for failures attributable to third-party providers.
15. SUSPENSION AND TERMINATION
15.1 Sevahetu reserves the right to:
- Suspend
- Restrict
- Terminate access
In case of:
- Misuse
- Violation of Terms
- Unlawful activity
16. FORCE MAJEURE
Sevahetu shall not be liable for delays or failures caused by events beyond reasonable control, including:
- Natural disasters
- Government actions
- Network failures
- Technical disruptions
17. MODIFICATION OF TERMS
17.1 These Terms may be updated at any time.
17.2 Continued use of the Platform constitutes acceptance of updated Terms.
18. ELIGIBILITY AND AGE RESTRICTION
18.1 Strict Age Requirement: You must be at least 18 years of age to access, register, and use the Platform and Services.
18.2 Legal Capacity: By accessing or using the Platform, you represent, warrant, and confirm that you are 18 years of age or older and possess the legal authority to enter into a binding agreement under the Indian Contract Act, 1872.
18.3 Minor Users: Individuals under the age of 18 are not permitted to independently create an account or use the Platform and Services on their own. However, parents or legal guardians may add their minor children as family members and use the Platform and Services on their behalf. In any emergency situation, the presence of an adult family member with the minor shall be mandatory.
18.4 Right to Terminate: If Sevahetu discovers or has reason to believe that a User is under the age of 18, we reserve the right to immediately suspend or terminate their account and refuse access to the Services without any prior notice or liability.
19. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India. All disputes shall be subject to the jurisdiction of courts in New Delhi.
20. GRIEVANCE REDRESSAL
20.1 If you have any complaints, concerns, or grievances regarding the use of the Platform, services, or processing of your data, you may contact our designated grievance officer.
